1. Your account

If you use the website, you are responsible for:

Please ensure that the details you provide us with are correct and complete and inform us immediately of any changes to the information that you provided when registering. You can access and update your information in the Change details area of the website.

1.2. Maintaining the confidentiality of your account and password and for preventing unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner.

 

2. Privacy

We will do our utmost to keep your data secure and Wellards Academy will never pass your details on to a third party. JMH Publishing Ltd, which owns Wellards Academy, is registered under the Data Protection Act 1998 — Licence Number: Z 7608218. For your security, we do not store any credit card details, and when using the e-commerce part of the site, you will be required to input such details every time you make a payment.

 

3. Access to Wellards Academy

We will do our utmost to ensure that availability of www.wellards.co.uk will be uninterrupted and that transmissions will be error-free. However, due to the nature of the internet, this cannot be guaranteed. Also, your access to the website may also be occasionally suspended or restricted to allow for repairs, maintenance, or the introduction of new services. We will attempt to limit the frequency and duration of any such suspension or restriction. Wellards Academy reserves the right to refuse access to the website, terminate accounts, remove or edit content at our discretion.

3.1. Access to premium-content areas (eg, Association of the British Pharmaceutical Industry distance learning programme and Code of practice) is dependent on having a valid Wellards Academy account.

 

4. Our contract

When you pay Wellards Academy for an account or a product, we will send you an email confirming receipt of your order and containing the details of what you have paid for. Your order represents an offer to us to purchase a product which is accepted by us when we send email confirmation to you containing details of what you have paid for (the 'Confirmation Email').

 

5. Returns

Wellards Academy will accept return within 30 days of purchase of a book in good-as-new condition and will refund for this; but will give no refunds for unexpired time on an account to use Wellards Academy.

 

6. Electronic communications

When you visit Wellards Academy, take an exam or send emails to us, you are communicating with us electronically. We communicate with you by email or by posting notices on the website. For contractual purposes, you consent to receive communications from us electronically and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

 

7. Losses

Wellards Academy will be responsible for any losses you suffer as a result of us breaching these conditions if the losses were reasonably foreseeable to both you and us when you commenced using the website, or a contract for the sale of goods by us to you was formed. We will not be responsible for any business loss (including loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure) or any other indirect or consequential loss that is not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of goods by us to you was formed. Wellards Academy does not limit in any way our liability by law for death or personal injury caused from our negligence or breach of duty or caused by our gross negligence or wilful misconduct.

 

8. Alteration of service or amendments to the conditions

We reserve the right to make changes to our website, policies, and these terms and conditions at any time. You will be subject to the policies and terms and conditions in force at the time that you use the website or that you order goods from us, unless any change to those policies or these conditions is required to be made by law or government authority (in which case it will apply to orders previously placed by you). If any of these conditions is deemed invalid, void, or for any reason unenforceable, that condition will be deemed severable and will not affect the validity and enforceability of any remaining condition.

 

9. Clinical material

Clinical information on Wellards Academy is not intended to be used to diagnose or treat a healthcare condition. If you have health concerns, please see a healthcare professional.

 

10. Scoreboard

The scoreboards of Wellards Academy list the top scores achieved in a particular exam in your company and across the industry.

10.1. Only those achieving distinction are eligible for the scoreboard – that is getting a mark of 90 per cent or over in every module on the first attempt.

10.2. The score used to calculate the place on the scoreboard is an average of the scores of all modules of the course. The score for a module is calculated using time taken to complete the exam and percentage correct.

10.3. Once you have completed all modules, the average of the scores will be your final course score, and this is what decides your place on the scoreboard.

10.4. Wellards Academy reserves the right to remove anyone from scoreboards without notice and without giving a reason.

10.5. The decision of Wellards Academy in scoreboard matters is final.

 

11. Exams

11.1. The decision of Wellards Academy is final in all exam matters.

11.2. Where your company pays for your account, appeals should be first addressed to your training manager.

11.3. Wellards Academy assumes that students will make every effort to take exams under reasonable exam conditions by:

11.3.1. Preventing avoidable interruptions.

11.3.2. Ensuring their computer and internet connection are in good order.

11.4. Wellards Academy is not responsible for any consequences of you taking or not taking any exam on www.wellards.co.uk.

 

12. Companies and training managers

12.1. If your account is paid for by your company, Wellards Academy may, at the request of your training manager, withdraw access without giving notice.

12.2. If you wish to move your account to another company, Wellards will seek the permission of both your new company and the company under which you held the account. Wellards Academy will remove permanently all company-specific exam results and recommended reading relating to your old company from your account.

12.3. Your training manager and team leader have access to a record of your account's activities on the site. Wellards Academy is not responsible for any action taken by them in response to these records.

 

13. Copyright

Wellards Academy or other parties hold the copyright to all material on www.wellards.co.uk.

13.1. As an account-holder with Wellards Academy, you have permission to take from the site Presentations to download, amend them and present them to any audience.
