Monitor presents foundation trust de-authorisation plans

Hospital corridor Final plans on who can take action against failing foundation trusts have been presented for consultation by Monitor.

With the Department of Health having to retreat on earlier ideas to empower ministers to take action against failing foundation trusts, the independent regulator proposes either:

  • Monitor can consider de-authorising a foundation trust which is seriously failing to comply with its terms of authorisation or any requirement imposed on it under any enactment; or
  • the Health Secretary may write to Monitor requesting that it considers the de-authorisation of a foundation trust

This consultation closes on 26 May 2010.

Three further acute trusts have been granted foundation status, taking the total to 129, of which 40 are mental health foundation trusts:

  • Cornwall Partnership NHS Foundation Trust
  • Five Boroughs Partnership NHS Foundation Trust
  • South Warwickshire NHS Foundation Trust

Acting chief executive appointed
Meanwhile, Chris Mellor (acting chair of Monitor) has announced that Dr David Bennett has been appointed as interim chief executive.

Dr Bennett was previously chairman of the 10 Partnership, providers of strategic and operational support to the public sector, particularly in health.
